We appreciate that for commercial landlords, initiating Enforcement Agent action to recover unpaid rent is a last resort – not least because of the risk of losing a tenant and finding a replacement.

Commercial Rent Arrears (CRAR)

CDER Group will issue a Notice of Enforcement to the tenant within 24 hours of receipt of the warrant, usually on the same day.

 

If we have not received full payment of the outstanding amount or negotiated an acceptable payment plan by the expiry of the required 7-day period, we will immediately attend the premises to take control of goods.

 

There is no charge to you for this service.

 

When we collect the arrears, we will add our costs to the amount outstanding to be paid by the tenant.

 

You must complete a Warrant to Control to instruct us to start enforcement action.

Forfeiture/Possession

If you, as a landlord, have decided to end the commercial tenancy, CDER Group can complete the forfeiture of the lease and take possession of the commercial property on your behalf.

 

We ensure that the lease is forfeited by peaceful entry of the premises, that locks are changed by locksmiths who are members of the Master Locksmiths Association and that Notices of Forfeiture are correctly displayed.

 

We will provide a complete inventory of goods supported by photographic evidence.

 

Our fees for this service are £425.00 plus VAT plus the invoiced cost of a locksmith.

 

You must complete a Warrant of Possession/ Forfeiture to instruct us to initiate enforcement action.

Trespasser Removal

As a landowner, you do not require a Court Order to remove trespassers from your property. You can authorise an Enforcement Agent to serve notice to leave under Common Law or the Criminal Justice and Public Order Act 1994.

 

If trespassers are occupying your land, you should contact us for advice on the most appropriate way to proceed with eviction action.

 

Upon instruction to proceed, CDER Group will serve notice within 24 hours.

 

Our fees: an Enforcement Agent's attendance to serve notice costs £480.00 plus VAT. Attendance to remove trespassers from the site will be determined by the location and number of Enforcement Agents required.
