Alongside the announced reforms to Enforcement regulations, the MOJ has launched a new consultation focused on the regulatory framework overseeing the use of the Taking Control of Goods procedure. This review includes certified enforcement agents, HCEOs, and the firms employing them.
The Government has expressed strong support for the work of the Enforcement Conduct Board (ECB) and has signalled its intention to legislate for independent statutory oversight of the enforcement sector.
Nick Tubbs, CEO of CDER Group, commented:
“CDER Group welcomes this consultation. We collect over £600 million in unpaid statutory taxes and fines annually for local and central government. Our collaboration with customers and debt advice partners helps identify over £25 million in unclaimed government support that our customers can—and do—access with our help.
Having been a key enabler in the establishment of the ECB and an advocate for independent oversight since 2017, we believe statutory underpinning of the ECB is the next logical step. It will strengthen partnerships between creditors and the debt advice sector for better outcomes.”
